Lawyers of Distinction member Christopher B. Meagher, Esq. and Keith J. Clarke, Esq. of Meagher and Meagher P.C., recently obtained a $7,605,699.95 verdict in a trial presided over by Judge William J. Giacomo in Westchester Supreme Court. The case alleged that three separate clinicians (neurosurgeon, ENT, pediatric neurologist) failed to independently review MRI images of the skull of a 13-month-old child who they suspected had a skull-based structural lesion. The failure to review these images resulted in the lesion growing significantly and going undiagnosed for approximately one year. The growth of the lesion complicated its removal and the child was left with permanent left sided facial paralysis and partial left-sided hearing loss. After approximately three weeks of trial, which involved expert witnesses from the three distinct specialties, the jury deliberated several days and rendered the above verdict in favor of the plaintiffs.
